Terms of Service

These Terms of Service ("Terms") govern your use of the PinWeather website at pinweather.com and the PinWeather mobile application (collectively, the "Service") operated by PinWeather ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

PinWeather provides golf-specific weather forecasts, shot-impact calculations, rain nowcasting, radar imagery, and related tools. Forecasts are generated from third-party weather models and are provided for informational purposes only. Weather forecasts are inherently uncertain — we do not guarantee the accuracy, completeness, or timeliness of any forecast, and you should not rely on the Service for safety-critical decisions.

2. Accounts

You may use limited features of the Service without an account. To save courses, access personalized features, and subscribe to Pro, you must create an account using a valid email address or by signing in with Google or Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You may delete your account at any time from within the app through your account or profile settings, or by emailing us at hello@pinweather.com. Upon deletion, your profile, course pins, and associated personal data will be removed within 30 days, as described in our Privacy Policy.

3. Free and Pro Tiers

The Service offers a free tier and a paid Pro tier. Free accounts are limited to one pinned course and a limited number of historical weather queries. Pro unlocks additional features, including unlimited course pins, rain nowcasting, radar imagery, wind compass, wind charts, and historical weather data. The specific features included in each tier may change over time.

4. Subscriptions, Payments, and Auto-Renewal

Pro subscriptions are available as auto-renewing subscriptions. When you subscribe, you agree to the pricing and billing frequency displayed at the time of purchase.

Auto-renewal. Your Pro subscription will automatically renew at the end of each billing period (monthly or annually, depending on the plan you select) at the then-current subscription price, unless you cancel before the renewal date. You will be charged for the renewal within 24 hours prior to the end of the current billing period.

How to cancel. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain Pro access until then. To cancel:

• iOS: Go to Settings → [your name] → Subscriptions → PinWeather → Cancel Subscription
• Android: Go to Google Play → Payments & subscriptions → Subscriptions → PinWeather → Cancel
• Web (Stripe): Manage your subscription from within the PinWeather app, or contact us at hello@pinweather.com

Refunds. Refunds for purchases made through the Apple App Store or Google Play Store are governed by the respective store's refund policies. For web purchases made through Stripe, refunds are handled on a case-by-case basis — contact us at hello@pinweather.com.

Price changes. We may change subscription prices from time to time. Price changes for existing subscribers take effect at the start of the next billing period following reasonable notice.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access another user's account or data
• Scrape, crawl, or programmatically access the Service without our prior written permission
• Interfere with or disrupt the Service or its infrastructure
• Resell, redistribute, or sublicense weather data or other content obtained from the Service
• Reverse-engineer, decompile, or disassemble any part of the Service

We reserve the right to suspend or terminate your account if you violate these Terms.

6. Intellectual Property

The Service, including its design, code, branding, logos, and content, is owned by PinWeather and protected by applicable intellectual property laws. "PinWeather" is a trademark of PinWeather. You may not use our name, logos, or trademarks without prior written permission.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY FORECAST WILL BE ACCURATE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PINWEATHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST PROFITS, OR PERSONAL INJURY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless PinWeather and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Service.

10. Third-Party Services

The Service integrates with third-party services (including weather data providers, payment processors, and authentication providers) as described in our Privacy Policy. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is subject to their respective terms and policies.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or sending you an email. The "Effective" date at the top indicates when the Terms were last revised. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Los Angeles County, California.
